De nombreuses critiques ont été formulées à l’encontre du jugement condamnant Nicolas Sarkozy à une incarcération « avec mandat de dépôt à effet différé assorti d’une exécution provisoire », c’est-à-dire sans attendre l’issue de sa procédure d’appel. Cette exécution provisoire de la peine d’emprisonnement est pourtant banale. En 2022, 55 % des peines d’emprisonnement ferme prononcées par le tribunal correctionnel ont ainsi été mises à exécution immédiatement.
