The following are Human Rights Watch’s comments in response to the US Department of Education’s proposal to amend regulations implementing Title IX of the Education Amendments of 1972 (Title IX) published November 29, 2018 (Docket ID ED-2-18-OCR-0064). The proposed regulations govern schools’ and institutions’ obligations to respond to sexual harassment. Harassment and gender-based violence may constitute discrimination if it interferes with or limits a student’s ability to participate in or benefit from educational programs or activities.
